Congressman Rush introduced this legislation November 1, 2007. I spoke with a staff member in his office this morning (Jan 8, 2009) and was assured that this will NOT affect the consignment and resale idustry. They agreed to send me a statement to publish on my site:
"The compliance and testing requirements should have no particular impact on thrift stores that sell children’s products. Compliance certificates for lead apply only to children’s products manufactured after February 10th 2009. The certificate requirement is imposed on manufacturers, not on retailers.

Since seasonal sales fall in the same category as thrift stores, this statement should apply to us. However, it is NOT a statement from the Consumern Product Safety Commission. We still need to take action to have this law amended.
